1. Introduction
Welcome to DataTabs!
These general terms and conditions (hereinafter: "GTC" or "Terms") govern the use of the DataTabs platform (data-tabs.com), the associated services, local and mobile applications and apps (hereinafter: "DataTabs apps") as well as their integration into other websites, applications and services (hereinafter collectively: "DataTabs services"). Certain functionalities and additional options may not be available for all services or require the registration of an account.
The contractual partner of a user is TJ-Tronics Systems GmbH, Holderweg 7, 42579 Heiligenhaus, Germany. The contractual partner is hereinafter referred to as TJ-Tronics Systems or TJ-Tronics. These terms and conditions come into force for all users registered via the platform from March 9, 2026 in accordance with the consent given upon registration.
Violation of any of the terms below may result in the termination of your account.
If you do not agree to these Terms, you may not access or use the Service.
2. Service description
- Users shall not use the Services for any purposes beyond the scope of the access granted in this Agreement.
- The content published by users does not represent the opinion of TJ-Tronics. They are generally not checked for accuracy, legality and completeness.
- TJ-Tronics reserves the right to make the use of DataTabs services or individual functions thereof or the extent of their use subject to certain conditions (e.g. verification of registration data, duration of use, payment behavior, etc.). This also includes restricting a user's account activities until these conditions have been verifiably met.
- TJ-Tronics reserves the right to change the DataTabs platform, provided that this is reasonable for the users, taking into account the legitimate interests of TJ-Tronics, no additional costs are incurred for the user, and the change serves the purpose of adapting the platform to technical developments or a changed number of users, changed usage behavior and changed user expectations.
- The right to use the platform only exists within the framework of the current state of the art technology. The services can be temporarily restricted if this is necessary due to capacity limits or the security and integrity of the servers.
- It is possible that technical problems may occasionally occur when visiting the platform. If an unforeseen system failure hinders the use of DataTabs services, users will be informed in an appropriate manner.
- Maintenance work will be announced.
- Consumers can assert warranty claims in accordance with statutory provisions and application of the limitation of liability. The provisions in paragraph 8 (exclusion of liability and limitations of liability) apply.
3. DataTabs account
- The prerequisite for using DataTabs is an account, with which the user agrees to these terms and conditions and the privacy policy. Upon registration, a contract for the use of DataTabs services (hereinafter: "User Agreement") is concluded between TJ-Tronics and the user. There is no entitlement to the conclusion of a User Agreement. The possibility of registration may be restricted based on the user's place of residence or place of business.
- Registration is only permitted for legal entities, partnerships and natural persons with full legal capacity and in particular excludes minors from registration. By using the Service, you represent and warrant that you meet this age requirement.
- You must have the legal capacity to enter into a binding contract. If you do not have such capacity, you may not use the Service.
- When registering a legal entity or partnership, this may only be done by a natural person who is authorized to represent them. Natural persons may only be registered as individuals, i.e. no families or married couples. Accounts created by "bots" or through any automated process are not permitted.
- The DataTabs account is not transferable.
- If the identity information changes, the user is obliged to update it immediately.
- Users are obliged to keep their password secret and to carefully secure access to the DataTabs account. Users are also obliged to inform TJ-Tronics immediately if there is any indication that their DataTabs account is being misused by a third party.
- Users are obliged to keep API keys secret and not to embed them in software or firmware that is delivered to customers in products. They may also not be stored in a source code management system. If there is any indication of compromise by third parties, TJ-Tronics must be informed immediately and the API key must be renewed.
- TJ-Tronics reserves the right to delete incomplete or inactive accounts with reasonable advance notice.
- We may offer an application programming interface that provides additional ways to access and use the DataTabs Service (“API“). Such API is considered a part of the service, and your use of the API is subject to the terms of this agreement. We reserve the right at any time to modify or discontinue your access to the API (or any part of it) with or without notice. The API is subject to changes and modifications, and you are solely responsible to ensure that your use of the API is compatible with the current version.
- The user may not use the Service for any illegal purpose or to violate any laws in your jurisdiction (including but not limited to copyright laws).
- You may not create more than one Account, and you may not share your User Login with others.
4. Use of the platform
- Subject to users’ payment of all subscription fees and compliance with this agreement, TJ-Tronics grants to user a worldwide, non-exclusive, non-transferable, non-sublicensable right during the subscription term to use the services in accordance with the applicable subscription plan and documentation, and solely in connection with user’s internal business operations.
- Users may not block, overwrite, modify or otherwise interfere with TJ-Tronics' services in any way, including content generated by TJ-Tronics or other users, particularly if this could result in an excessive load on the DataTabs infrastructure.
- TJ-Tronics provides support through the general help section to resolve general issues related to the DataTabs account and use of the DataTabs platform. TJ-Tronics support is also available through the contact section. TJ-Tronics is not responsible for providing support to users.
- TJ-Tronics acknowledges that, as between DataTabs and User, the User owns all right, title, and interest, including all intellectual property rights, in and to the User Data. User hereby grants to TJ-Tronics a non-exclusive, royalty-free, worldwide license to reproduce, distribute, and otherwise use and display the User Data and perform all acts with respect to the User Data as may be necessary for TJ-Tronics to provide the Services to User, and a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to reproduce, distribute, modify, and otherwise use and display User Data incorporated within the Aggregated Data. Customer may export the User Data at any time through the features and functionalities made available via the Services.
5. Termination
- Users may terminate this user agreement at any time.
- TJ-Tronics can terminate the user agreement at any time with 30 days' notice to the end of the month. The right to block access and the right to extraordinary termination for good cause remain unaffected.
- If a user has been blocked or the user agreement has been terminated by TJ-Tronics, the user is not permitted to use the platform with another account and to register again. Blocking or termination has no effect on the validity of contracts already concluded on the platform.
6. Subscription, Fees & Payment Terms
- Subscription plans are available here.
- Subscriptions are billed in advance on a monthly or annual basis (as selected by the User) and will automatically renew at the end of each billing cycle unless cancelled before the renewal date.
- By providing a payment method, the User authorizes TJ-Tronics to charge the applicable fees to that payment method. The User must provide a valid payment method.
- All payments, fees and other amounts payable by User under this agreement are displayed exclusive of taxes and similar assessments.
- Fees and prices may be changed by TJ-Tronics at any time. Price changes will be communicated in good time before they come into effect.
- Payments must be made exclusively to the account stated on the reverse of the invoice. Cash discounts are only permitted if specifically agreed in writing.
- Unless otherwise stated, invoices are payable within 14 days of invoicing.
- Subscription plans can be changed or cancelled at any time.
- On downgrade to a lower-tier Subscription Plan, the User may lose access to certain features, and User Content may be subject to storage limits. We are not responsible for any loss of User Content resulting from a downgrade.
- If we do not receive payment from the User payment method, we may suspend or terminate the Account. The User will be responsible for all costs of collection, including reasonable attorneys' fees.
- On cancellation of a subscription, the User will continue to have access to the Service until the end of your current billing cycle but will not receive a refund for any unused portion.
- Subscriptions are generally non-refundable. However, refunds may be granted at our discretion in case of unresolved technical issues over a set period or accidental duplicates. Refunds generally do not apply to changes of mind, failure to cancel, or service termination due to policy violations. Requests have to be emailed with User account details. Approved refunds are typically processed within 7 business days.
- For EU consumers: By using DataTabs, the User explicitly consent to the immediate performance of the contract. The service is available to Users as soon as they sign up; in other words, the value of the service is delivered at the beginning of the billing period. Because of this, the user acknowledges that he will lose the right to the 14-day withdrawal period (cooling-off period) provided under EU consumer protection laws with begin of use of the Service.
- We may offer a free trial period. The free trial period is 14 days unless otherwise specified. The user may use a trail period to verify their requirements before purchasing a subscription.
7. Copyright
All content included in or made available through the DataTabs platform, such as text, graphics, logos, icons, images, digital downloads and data compilations, is the property of TJ-Tronics or third parties who supply content or make it available on the platform and is protected by German and international copyright and database law. The entirety of the content included in or made available through the DataTabs platform is also the exclusive property of TJ-Tronics and is protected by German and international copyright and database law.
8. Disclaimer and Limitation of Liability
- TJ-Tronics is liable in accordance with the statutory provisions for intent and gross negligence on the part of TJ-Tronics, its legal representatives, senior employees or other vicarious agents.
- Liability for indirect and unforeseeable damages, loss of production and use, loss of profits, lost savings and financial losses due to claims by third parties is excluded in the case of simple negligence - except in the case of injury to life, body or health.
- Any further liability on the part of TJ-Tronics is excluded.
- To the extent that the liability of TJ-Tronics is excluded or limited, this also applies to the personal liability of its legal representatives, employees, workers and vicarious agents.
The following exclusions and limitations apply notwithstanding any failure of essential purpose of any limited remedy.
8.1 Disclaimer
TJ-Tronics provides the Services and Platform on an "as is" and "as available" basis. Except as expressly set forth as "Warranty" in this Agreement and to the fullest extent permitted by law, TJ-Tronics makes no warranties and statutory warranties, express and implied, with respect to its performance under this Agreement, the Services, the Technology, the Data and the Documentation, including with respect to availability, the implied warranties of fitness for a particular purpose, merchantability and non-infringement, and the implied warranties arising from course of dealing, performance or usage of trade, and expressly disclaims all such warranties. TJ-Tronics shall not be liable for any loss, damage or expense you or others may incur from or in connection with any hacking, tampering or other unauthorized access to or use of the Services, your DataTabs account or protected data, or your failure to use or implement anti-fraud or data security measures. In addition, TJ-Tronics will not be liable for any loss, damage or expense incurred by you or others arising out of or relating to (a) your access to or use of the Services in a manner inconsistent with this Agreement or the Documentation; (b) unauthorized access to servers or infrastructure or to TJ-Tronics data or proprietary data; (c) service interruptions or failures; (d) bugs, viruses or other malicious code that may be transmitted to or through the Service; (e) errors, inaccuracies, omissions or losses in or to proprietary data or TJ-Tronics data; (f) Content; or (g) your or any other party's defamatory, abusive, fraudulent or illegal conduct.
8.2 Limitations of Liability
(a) Indirect Damages. To the extent permitted by law, TJ-Tronics will not be liable to any user with respect to this Agreement or the Services during or after the Term for any lost profits, personal injury, property damage, loss of data, business interruption, indirect, incidental, consequential, exemplary, special, reliance or punitive damages, even if such losses, damages or costs are foreseeable and whether or not the user or TJ-Tronics was advised of their possibility.
(b) General Damages. To the extent permitted by law, TJ-Tronics shall not be liable to any user for any loss, damage or expense in relation to this Agreement or the Services during or after the Term (whether in contract, negligence, strict liability or tort or under any other legal or other theory).
9. Choice of law and place of jurisdiction
- These General Terms and Conditions and the contractual relationship between TJ-Tronics and the user are subject to the law of the Federal Republic of Germany, excluding international uniform law, in particular the UN Convention on Contracts for the International Sale of Goods.
- If the user is a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, our place of business in Heiligenhaus is the exclusive and international place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The same applies if the buyer is an entrepreneur within the meaning of Section 14 of the German Civil Code.
- We are also entitled to file a lawsuit at the place of performance of the delivery obligation in accordance with these General Terms and Conditions or a prior individual agreement or at the general place of jurisdiction of the buyer. Priority statutory provisions (exclusive places of jurisdiction) remain unaffected by this.
10. Final provision
- TJ-Tronics is entitled to transfer its rights and obligations arising from this contractual relationship in whole or in part to a third party with a notice period of four weeks. In this case, the user also has the right to terminate the contract at any time without notice and free of charge.
- TJ-Tronics can propose a change to these General Terms and Conditions to the user at any time in text form (e.g. by email) with a lead time of at least 30 days before the proposed date of their entry into force. The change offered to the user only comes into force if the user agrees to the changes. In the case of a significant change, the user agrees to it with express consent; in the case of an insignificant change, consent is deemed to have been given unless rejected in text form to TJ-Tronics before the proposed date of entry into force. Changes are then significant if they significantly change the previously agreed relationship between performance and consideration to the detriment of the user or are equivalent to the conclusion of a completely new contract. A change resulting from a change in the law, a legally binding court judgment or an interim injunction does not constitute a significant change.
- Should individual provisions of these General Terms and Conditions be or become invalid or ineffective in whole or in part, this shall not affect the validity of the remaining provisions.
- All declarations transmitted within the framework of the user agreement concluded with TJ-Tronics must be made in writing or text form (e.g. by email).
